In this agreement the following words shall have the following meanings/interpretation/full form : “Website” means the official website of Barefoot Resorts viz., www.barefoot-andaman.com/ “User” means an individual, firm or entity who have accessed the portal/website of Barefoot Resorts. “E-voucher” means any electronic confirmation issued by us, through your use of our accommodation booking portal/website/other correspondence for your selected days of stay over the accommodation specified by the “Barefoot Resorts”. This could be an e-voucher you get printed from the portal/website, or what is obtained from authorized agents/franchisees of Barefoot Resorts. “Reservation ID” means the unique 6-digit number generated by the system on every successful booking. ‘Payment Gateway’ means the website of the credit card processing bank where you will be furnishing your credit card details for making payment towards the cost of service you have availed using our website.

The services offered by Barefoot Resorts on their portal/website are specified below. The same services will also be available through their authorized agents/franchisees at various locations. However, these service providers may have made different restrictions/limitations in the packages offered, and Barefoot Resorts is not responsible for any such limited service offered or for such differences in service between any two or more such service providers. Advance reservation in any type or class of accommodation is offered by Barefoot Resorts on full payment for both adults and children, for accommodation on any available dates and room vacancy on any of their resorts, subject to terms of booking specified by Barefoot Resorts. General inquiries such as accommodation availability, tariff for various types or classes of accommodation offered by Barefoot Resorts, check-in and check-out timings, discounts and packages offered, etc. On-line cancellation of booked accommodations is subject to cancellation rules set by Barefoot Resorts and the Credit Card issuing bank. Issue of duplicate reservation vouchers, change of stay date, and amendments to the bookings made subject to certain charges for change in stay dates.
 

Barefoot Resorts provides the facility for transacting, reservations, and issuing of e-vouchers of accommodation booked through the internet and the online reservation system. Reservation and booking of accommodation and all transactions through this portal/website shall be governed by special conditions imposed for internet-based booking and by conditions set out by Barefoot Resorts from time to time.

The following terms and conditions will apply if you wish to use the portal/website of Barefoot Resort’s online reservation service. Please go through the conditions carefully and only if you accept them, you transact on the portal/website. Also please note that by transacting on the website, you are deemed to have read and agreed/accepted all the Terms and Conditions set forth here. In case you do not agree or accept any of the Terms and Conditions set forth here, please do not transact on this portal/website. Once you have proceeded to make a transaction on the website, you are deemed to have already agreed to the Terms and Conditions, the link to which is presented prior to the completion of booking, and you have entered into a formal agreement with Barefoot Resorts for the purpose of transactions on this portal/website.

Barefoot Resort’s performance of this agreement is subject to existing laws and legal processes of Govt. of India, and nothing contained in this agreement is in derogation of Barefoot Resort’s right to comply with law enforcement requests or requirements relating to your use of this portal/website or information provided to or gathered by Barefoot Resorts with respect to such use. You agree that Barefoot Resorts may provide details of your use of the portal/website to regulators or police or any other third party, or in order to resolve disputes or complaints which relate to the portal/website, at Barefoot Resort’s complete discretion.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between the user and Barefoot Resorts with respect to this portal/website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Barefoot Resorts with respect to this portal/website. A printed version of this agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

www.barefoot-andamans.com is registered under the name of Barefoot Resorts and Leisure Pvt Ltd. Barefoot Resorts acknowledges that the customers of Barefoot Resorts and Leisure Pvt Ltd and Barefoot Resorts and Leisure India Pvt Ltd will visit the website www.barefoot-andamans.com and purchase or avail services offered on the website.
